Justice or another Rape in waiting

Justice in this country is not a right but a luxury only few lucky victims get. You either have to be rich and influential or hope for good amount of media light on your case. Speaking of which I wounder if the Delhi rape victim had got this media attention if she would had been 'normally' rape minus the gruesome act that followed? I don't think so. It would have been just another rape and no one would had cared about it. There have been many cases in the past which were highlighted by the media and the Government came with the same trick to douse the fire  .. Fast Track court. Setting up a fast track court for a particular case is like sticking a Band-Aid on a wound which requires 100 stitches. 

As far as law and order in this country is concern, there are tones of laws but there is no order. So much so that if tomorrow your sister,wife,daughter or mother is raped I would suggest you to avoid going to Police station for registering FIR mainly because the rape victim plus her family will get raped second time. People who are shouting hang the rapist or the TV anchors who call on experts and discuss whats needs to be done have no clue of what the ground reality is. The trauma starts with the rape victims visit to the Police Station to register the FIR. If she is poor they will waste no time to term her a prostitute and show the door. Corruption on the other hand is the biggest culprit for low conviction in rape cases, cops deliberately start weakening the case during the registration of FIR itself. Above that if the rapist is rich and influential person then only God could give justice to that victim.

The second stage of the second rape of the victim happens to be the court room. Defense lawyers are ruthless when it comes to defending there client and they can go to any length to prove that it was a consensual sex or the victim is characterless. Judges usually look at the trail strictly through legal prospective and hence sensitivity is sidelined. It takes unimaginable bravery and courage for a rape victim to go through the entire process without breaking down. At last on the judgement day 80% of the victims see there rapist walk away with a smile on there face since the conviction rate of rape cases in this country is mere 20%. One cant even imagine the trauma the victim has to surfer when she looks on as her rapist is acquitted. The Question I want to ask that is it worth it if the chances of getting justice is only 20%? isn't the victim better off if she bites the bullet and forget justice?  

Have been hearing a lot on the TV of what needs to be done. What is the Solution? People are talking about changing the 'mindset' of men. Really? Is it really possible to change mindset of 1 billion people in this country? Certainly not and the fact is there is no diagnosis the government has which can change mindset of even a single man. I don't understand why these expert talk about solutions which cant be implemented. What is possible though is it to inject fear of law into people which does not exits and which is the main reason why criminals are going crazy. Conviction of criminals/rapist is the major issue which needs to be looked into. People wont fear law unless the conviction rate increases. The first stage of FIR and investigation can be done professionally if the police are held accountable for there actions and to force accountability we need Police Reforms which have been ignored even after Supreme Court rulings  The Politician do not want to let go there powers on Police administration  So if there any one who should be blame for the mess its the Politician. Although the Government is trying to address the issue of judicial delays by setting up fast track courts but I feel its highly illogical. If the conviction rate is 20% the fast tract courts will end up serving the rapist. Unless and until the the stage of reporting the crime and investigation is address fast track court will not serve any purpose. Another important cause of this menace is the socio economic development of the masses; especially the poor class. Its the responsibility of the government to look at this matter with wider a prospective. Why are so many people turning to crimes in such an alarming rate? its mainly because the government has miserably failed to to uplift the poor class. No one is a born criminal, its the circumstances which turn them into criminals. Poverty and no hope of living a normal life like we do frustrates these people and unfortunately innocent people become the victims of such Anger.

All the people holding candles in there hands and expressing there protest or solidarity need to understand that unless we channel this agitation properly for a specific demand, we would be left empty handed. Few months later there will be another gang-rape and the victim could be someone you care for. Instead of chanting 'Death to Rapist' or 'We want Justice' , what we really need to chant is 'We want Police Reforms'.
